1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of ESeller360 (the "Service"), a seller productivity application operated by Hive Mind Nestor Private Limited ("Hive Mind Nestor", "we", "us", or "our"). By registering for an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
ESeller360 is a software-as-a-service application that helps Etsy shop owners manage their shop operations. The Service integrates with the Etsy Open API v3 to provide listing creation and editing, bulk operations, order management, inventory monitoring, and shop analytics. ESeller360 is an independent tool and does not replace, replicate, or compete with the Etsy marketplace.
3. Etsy Account Connection & Authorization
To use the Service, you connect your Etsy shop through Etsy's standard OAuth 2.0 Authorization Code flow. By connecting your shop, you authorize ESeller360 to access and act on your Etsy shop data through the Etsy Open API v3, limited to the scopes requested during authorization.
You must own or be authorized to manage the Etsy shop you connect. You may disconnect your Etsy shop and revoke ESeller360's access at any time from within the application settings or from your Etsy account. Your use of Etsy and its API is also subject to Etsy's own terms and policies.
4. Acceptable Use
You agree not to:
- Use the Service to access any Etsy shop other than one you own or are authorized to manage;
- Use the Service in violation of Etsy's API Terms of Use or marketplace policies;
- Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service;
- Use the Service for any unlawful, fraudulent, or abusive purpose;
- Resell, sublicense, or misrepresent the Service.
5. Seller Responsibilities
You are responsible for the accuracy of the listing, pricing, inventory, and order actions you perform through the Service, and for maintaining the security of your ESeller360 account credentials. You remain responsible for compliance with all Etsy marketplace policies and applicable laws governing your shop.
6. Subscription & Billing
ESeller360 is offered on a subscription basis at $29 per month or $300 per year. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.
7. Disclaimer of Etsy Endorsement
ESeller360 is an independent application developed by Hive Mind Nestor Private Limited. The term "Etsy" is a trademark of Etsy, Inc. ESeller360 uses the Etsy API but is not endorsed, certified, affiliated with, or sponsored by Etsy, Inc.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements. The Service depends on the availability of the Etsy Open API v3, which is outside our control.
To the maximum extent permitted by law, Hive Mind Nestor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users. Upon termination, your Etsy shop data and OAuth tokens are deleted in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or through a notice within the Service. Continued use of ESeller360 after updates take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of Agra, Uttar Pradesh, India.
